  • a) Einwilligung
    nur bei unproblematischen Fällen sinnvoll
    "Betroffene Person hat jederzeit Recht auf Widerruf" ohne Begründung
  • b) Verträge
    Datenverabreitung "hängt" an Laufzeit des Vertrages
  • f) "Berechtigtes Interesse"
    gut für viele Situationen
    Widerspruch (Artikel 21) außer Verarbeiter hat
    "zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die die Interessen, Rechte und Freiheiten der betroffenen Person überwiegen"
   Data processing is generally prohibited
6 Lawfulness of Processing
Article 6 - Section 1 - GDPR
  • a) Consent from subject
    only useful in easy to handle situations
    "withdraw his or her consent at any time" without reason
  • b) Perform Contracts
    data processing depends on duration of contract
  • f) "Legitimate Interests"
    this is good for many conditions
    Right to object (Article 21) except controller of processing
    "demonstrates compelling legitimate grounds for the processing which override the interests"

IP-Adressen sind laut EU-Gerichtshof persönliche Daten
damit benötigt jede Webseite eine Datenschutzerklärung
viele Informationspflichten wie Löschen, Ändern, Einschränken der Datenverarbeitung und über die Aufsichtsbehörde etc.

Weitere Problemfälle:
  • YouTube oder Vimeo-Videos
  • Soziale Netzwerke
  • Google Fonts
  • Google Analytics
  • Kontaktformular bedeutet zwingend https (sicheres Protokol)

every homepage needs data protection information
many obligations to inform about deleting, changing, restriction of data processing and about authorities etc.

  • YouTube or Vimeo videos
    (www.youtube-nocookie.com)
  • Social Networks
  • Google Fonts
  • Google Analytics
  • Contact form needs mandatory https (secure protocol)

Artikel 85 öffnet dies für nationale Gesetzgebung

Interpretation der deutschen Landesdatenschutzbeauftragten:
sofortige Information und Einwilligung von Abgebildeten ist nur theoretisch möglich und deshalb nicht erforderlich
bei Webveröffentlichung sollte man aber entsprechende Informationen in der Dateschutzerklärung haben
"Berechtigtes Interesse" gegen Interesse des Abgebildeten = Interessenabwägung
Wichtig: Nicht über den namen auffindbar
   great doubtfulness

Article 3 Section 2
This Regulation applies to ... b) the monitoring of their behaviour (GPS and time data)

Article 85 opens that for national legislation

Interpretation of German authorities
Instant information and consent is only theoretically possible
and with that not necessary
But, information about web publishing in your Data Protection Information
"Legitimate Interests" vs. interest of person = balancing of interests
Important: No search with name or other personal identification
